1. Agreement to Terms

By accessing or using Haroo Chat ("Service", "Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and Click click s.r.o., a company registered in the Czech Republic.

2. Eligibility

• You must be at least 15 years old to create an account and consent to data processing (Czech Republic minimum age)
• Users under 18 must have parental or guardian consent
• You must provide accurate and complete information during registration
• You may not use the Service if you have been previously banned
• You must comply with all applicable laws in your jurisdiction

3. Service Description

Haroo Chat is an AI-powered personality chat platform that enables users to:

• Create and customize AI characters
• Chat with AI characters using various AI models
• Purchase and use virtual currency ("Crystals") for chat interactions
• Earn creator commissions (10%) from personalities they create
• Receive daily rewards, achievements, and referral bonuses

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.

4. Account Responsibilities

4.1 Account Security

• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• Notify us immediately of any unauthorized access
• Do not share your account with others

4.2 Account Termination

We reserve the right to suspend or terminate your account for violations of these Terms, illegal activity, fraud, abuse, or at our discretion. You may delete your account at any time through account settings.

5. Crystal Economy

5.1 Purchase and Usage

• Crystals are virtual currency used to pay for AI chat interactions
• Different AI models have different costs (1-15 crystals per 1,000 tokens)
• Crystal purchases are final and non-refundable except as required by law
• Crystals have no monetary value and cannot be exchanged for cash
• Crystals do not expire but may be lost if your account is terminated

5.2 Pricing

We reserve the right to change crystal pricing and AI model costs at any time. Changes will not affect crystals already purchased.

5.3 Fraud Prevention

We employ fraud detection systems including device fingerprinting. Fraudulent activity will result in immediate account termination and potential legal action.

6. Creator Program

6.1 Commission Structure

• Creators earn 10% commission on crystals spent in chats with their personalities
• Commissions are calculated per interaction and credited to your crystal balance
• Commission rates are subject to change with 30 days notice
• Self-interactions do not generate commissions

6.2 Creator Responsibilities

• You retain ownership of AI characters you create
• You grant us a license to use, display, and distribute your personalities
• You must comply with our Content Policy and Community Guidelines
• You are responsible for the content of your personalities
• We may remove personalities that violate our policies

6.3 Tax Obligations

You are responsible for any taxes owed on earnings from the creator program. We may issue tax documentation as required by Czech or EU law.

7. Intellectual Property

7.1 Your Content

• You retain ownership of AI characters, descriptions, and avatars you create
• You grant us a worldwide, non-exclusive license to use your content to provide the Service
• You represent that you have all necessary rights to the content you upload

7.2 Our Content

The Service, including software, design, trademarks, and content we create, is owned by us and protected by copyright and other intellectual property laws. You may not copy, modify, or distribute our content without permission.

7.3 AI-Generated Content

AI-generated chat responses are created dynamically. While you may use these conversations for personal purposes, we do not claim ownership of AI outputs in your private chats.

8. Prohibited Conduct

You agree NOT to:

• Violate any laws or regulations
• Create personalities that promote illegal activities, hate speech, or violence
• Harass, threaten, or impersonate others
• Attempt to manipulate or exploit the crystal economy or referral system
• Use automated tools (bots, scripts) without authorization
• Reverse engineer, decompile, or hack the Service
• Interfere with the operation of the Service
• Share or sell your account
• Create multiple accounts to abuse rewards or referral systems
• Upload malicious code, viruses, or harmful content
• Scrape, crawl, or extract data from the Service

9. Adult Content Policy

Our platform may include adult (NSFW) content:

• Users must confirm they are 18+ to access adult content
• NSFW personalities must be properly labeled
• Illegal content (child exploitation, non-consensual content) is strictly prohibited
• We reserve the right to restrict or remove adult content at our discretion

10. Payment Terms

10.1 Payment Processing

All payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service and privacy policy.

10.2 Pricing and Taxes

• All prices are in EUR (or USD where applicable)
• Prices include applicable VAT as required by EU law
• Currency conversion fees may apply based on your payment method

11. Disclaimers

11.1 Service Availability

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We do not guarantee uninterrupted, error-free, or secure access.

11.2 AI Limitations

• AI-generated responses may be inaccurate, inappropriate, or offensive
• AI is not a substitute for professional advice (medical, legal, financial)
• We are not responsible for AI-generated content
• Users interact with AI at their own risk

11.3 Third-Party Services

We integrate with third-party services (Stripe, AI providers). We are not responsible for their availability, performance, or policies.

12. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, consequential, or punitive damages
• Our total liability is limited to the amount you paid in the 12 months prior to the claim
• We are not liable for loss of data, profits, or business opportunities
• These limitations apply even if we were advised of potential damages

Some jurisdictions do not allow certain liability limitations. In such cases, our liability is limited to the fullest extent permitted by law.

13. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any laws or third-party rights
• Content you create or upload

14. Dispute Resolution and Governing Law

14.1 Governing Law

These Terms are governed by the laws of the Czech Republic and the European Union. Any disputes will be resolved in Czech courts.

14.2 Mandatory Consumer Rights

Nothing in these Terms affects your mandatory consumer rights under EU law, including the right to a 14-day cooling-off period for purchases.

14.3 Informal Resolution

Before filing a formal claim, please contact us at info@click-click.cz to resolve the issue informally.

15. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes via email or prominent notice on the platform at least 30 days before they take effect. Continued use after changes constitutes acceptance.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
